    Trijex, a simplified joint-stock company (SAS) with a share capital of €1,000, registered in the Evry Trade and Companies Register under number 903 531 861, with its registered office at 31 avenue de la République, 91260 Juvisy-sur-Orge, France (hereinafter "UnCafé", "we" or "our").

    UnCafé offers a service connecting people for coffee breaks through the mobile application "UnCafé" available on the App Store and Google Play (the "Application") and the website https://www.uncafeapp.com (the "Site"), collectively referred to as the "Platform".

    Article 1 – Definitions

    • Application: the UnCafé mobile application available on the App Store and Google Play Store.
    • Coffee or Coffee Break: a meeting organised between two Users at a Partner Venue through the Services.
    • Account: the personal space created by the User upon registration on the Application.
    • Terms: these terms and conditions.
    • Partner Venue (or Spot): a café, bar or any other partner location selected by UnCafé where Coffee Breaks take place.
    • Match: a situation in which two Users are suggested to each other by the algorithm and both mutually accept the meeting.
    • Platform: the Application and the Site, taken together.
    • Services: all services provided by UnCafé through the Platform.
    • Site: the website accessible at https://www.uncafeapp.com.
    • Slot: a weekly time slot booked by the User for a Coffee Break (Sundays at 3pm).
    • User: any natural person using the Services.
    • Area: the geographical area in which the User is looking for a Coffee Break.

    Article 2 – Purpose and Acceptance

    These Terms define the conditions for accessing and using the Services offered by UnCafé.

    By creating an Account on the Platform, the User acknowledges having read these Terms and accepts them without reservation. If the User does not accept the Terms, they must not use the Services.

    The original version of these Terms is written in French, which prevails in the event of any discrepancy with any translation.

    Additional conditions may supplement these Terms. In the event of a conflict, the additional conditions shall prevail.

    Article 3 – Access to Services and Registration

    To use the Services, the User must:

    • Be at least 18 years old;
    • Have the legal capacity to enter into a contract;
    • Not have been previously banned from the Services, unless authorised in writing by UnCafé;
    • Not have been convicted of a violent or sexual offence;
    • Have only one Account;
    • Be legally permitted to use the Services under the laws of their country of residence.

    Registration is done through the Application using an SMS-verified phone number. The User then completes their profile (first name, email, gender, date of birth, profession, languages, relationship status, interests, photos, etc.).

    The User warrants the accuracy and truthfulness of the information provided and undertakes to keep it up to date.

    The User is solely responsible for the confidentiality of their Account and all activity conducted from it. They undertake to notify UnCafé immediately of any unauthorised use.

    Article 4 – Description of Services

    UnCafé offers a service connecting two people for coffee breaks at Partner Venues. The Services include:

    • Creation and management of the User profile;
    • Booking of weekly Slots for a Coffee Break;
    • Matching with other Users based on defined preferences (age range, duration, geographical area);
    • Organisation of Coffee Breaks at Partner Venues;
    • Built-in messaging (accessible 2 hours before the Coffee and persistent if a friendship is formed);
    • Review system after meetings;
    • Friend requests (available 1 hour after the Coffee).

    UnCafé does not guarantee:

    • The permanent availability of Matches;
    • The actual compatibility between Users;
    • The number of active Users at any given time;
    • The behaviour of Users during or outside Coffee Breaks.

    Consumptions at Partner Venues are the sole responsibility of the Users and are not included in the price of the Services.

    Article 5 – Booking and Conduct of Coffee Breaks

    • The User books a weekly Slot through the Application in their chosen Area;
    • The matching algorithm suggests matches based on the User's preferences;
    • The User may accept or reject suggested Matches (maximum 4 pending Matches);
    • When both Users mutually accept, a Coffee Break is created;
    • A Partner Venue is assigned to the Coffee Break;
    • Messaging opens 2 hours before the Coffee time;
    • After the Coffee, Users are invited to leave a review of the meeting and the venue;
    • 1 hour after the Coffee, Users may send each other a friend request.

    UnCafé reserves the right to change the assigned Partner Venue in case of unforeseen circumstances.

    Article 6 – User Obligations

    The User undertakes to:

    • Provide accurate, truthful and up-to-date information;
    • Not impersonate another person or provide misleading information;
    • Treat other Users with kindness and courtesy, both online and during Coffee Breaks;
    • Attend the Coffee Break at the agreed time and place;
    • Not use the Services for commercial, advertising or solicitation purposes;
    • Not use the Services to harass, threaten or intimidate other Users;
    • Not share other Users' personal information with third parties;
    • Not develop third-party applications interacting with the Services without written authorisation;
    • Not circumvent the Platform's security measures;
    • Comply with all applicable laws and regulations.

    The User is solely responsible for their interactions with other Users, including during Coffee Breaks. UnCafé recommends exercising caution during any meeting.

    Article 7 – Prohibited Content

    It is strictly prohibited to publish or transmit through the Platform any content that is:

    • Illegal, defamatory, insulting, racist, xenophobic, sexist or discriminatory;
    • Pornographic or sexual in nature;
    • Violent, threatening or inciting violence;
    • Infringing on the privacy or intellectual property rights of third parties;
    • Misleading, fraudulent or constituting unauthorised advertising;
    • Containing viruses, malware or any harmful code;
    • Depicting minors without parental authorisation.

    Any breach may result in the immediate suspension or deletion of the Account, without notice or compensation.

    Article 8 – Subscription and Payment

    8.1 Free Tier and Premium Features

    Registration on UnCafé, profile creation, viewing matches, messaging and friend requests are free. Booking Slots to participate in a Coffee Break requires an active premium subscription.

    8.2 Premium Subscription

    Premium subscriptions are offered in plans (1 month, 3 months, 6 months). Current prices are displayed in the Application before any subscription. A 7-day free trial may be offered to new subscribers.

    8.3 Payment

    Payments are made exclusively through the in-app purchase systems of the distribution platform used by the User (Apple App Store or Google Play Store). UnCafé never has access to your banking details. The subscription amount is charged by Apple or Google upon confirmation of purchase. Transactions are subject to the terms and conditions of the relevant distribution platform (Apple Media Services or Google Play).

    8.4 Auto-Renewal

    Unless cancelled by you, the subscription automatically renews at the end of each period for an identical duration at the current price. The User is informed of this at the time of subscription. The User may manage and cancel their subscription at any time from their device settings: on iOS, via Settings > [name] > Subscriptions or via the App Store; on Android, via Google Play Store > Payments & subscriptions > Subscriptions. Cancellation of auto-renewal takes effect at the end of the current period. In accordance with Article L215-1 of the French Consumer Code, the User will be notified of the option not to renew their subscription no earlier than three months and no later than one month before the end of the period authorising rejection of renewal.

    Article 9 – Right of Withdrawal

    In accordance with Articles L.221-18 et seq. of the French Consumer Code, the User has a period of 14 calendar days from the date of subscription to exercise their right of withdrawal, without having to provide any reason.

    To exercise their right of withdrawal, the User may send a clear request to [email protected]. For purchases made via in-app purchases, refund requests must be directed to the relevant distribution platform: Apple (https://support.apple.com/HT204084) or Google (via the Google Play Store). The refund will be issued without undue delay, and no later than 14 days from receipt of the request, using the same payment method used for the initial transaction.

    If the User requested that the service begin before the expiry of the withdrawal period, they will be liable for an amount proportional to the service provided up to the date of withdrawal.

    Article 10 – Termination

    10.1 By the User

    The User may terminate their Account at any time:

    • From the Application: in the profile settings, under "Account & Security", by tapping "Delete my account".
    • By email: by writing to [email protected].

    Subscription cancellation must be done from the User's device settings: on iOS, via Settings > [name] > Subscriptions or via the App Store; on Android, via Google Play Store > Payments & subscriptions > Subscriptions. Cancellation by email to [email protected] is also possible. Cancellation takes effect at the end of the current period; the User retains access to premium features until that date. Deleting the Application does not cancel the subscription.

    10.2 By UnCafé

    UnCafé reserves the right to suspend or delete a User's Account, with or without notice, in the following cases:

    • Breach of these Terms;
    • Abusive, threatening or disrespectful behaviour towards other Users or Partner Venue staff;
    • Repeated reports by other Users;
    • Provision of false or misleading information;
    • Fraudulent or unlawful use of the Services;
    • Any case where the safety of Users or the integrity of the Services requires it.

    The User will be notified of the decision and its reasons. Current subscription periods are not refunded in the event of termination for breach of the Terms.

    Article 11 – Intellectual Property

    All elements of the Platform (texts, images, logos, graphics, software, databases, trademarks) are the exclusive property of Trijex or its licensors and are protected by intellectual property laws.

    The User is granted a personal, non-exclusive, non-transferable and non-assignable licence to use the Application for the duration of their registration, for strictly private and non-commercial purposes.

    Any reproduction, representation, modification or use of all or part of the Platform's elements for purposes not provided for herein is prohibited without the prior written authorisation of Trijex.

    By creating an Account, the User:

    • Warrants that they hold the rights to the content they publish (in particular their photos);
    • Grants UnCafé a worldwide, non-exclusive, transferable and sublicensable licence to use such content for the provision and promotion of the Services.

    Article 12 – Personal Data

    UnCafé processes the personal data of its Users in accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act of January 6, 1978, as amended.

    The terms of collection, use and retention of personal data are detailed in our Privacy Policy.

    By using the Platform, the User acknowledges having read this Policy. To delete their data, the User may delete their Account from the Application or contact [email protected].

    Article 13 – Liability

    13.1 Limitation of Liability

    UnCafé is a matchmaking service. As such, UnCafé shall not be held liable for:

    • The behaviour of Users, online or offline, including during Coffee Breaks;
    • The quality of Partner Venues, consumptions or the service provided therein;
    • The accuracy of information provided by Users;
    • Damages resulting from temporary unavailability of the Platform;
    • Interactions between Users outside the Platform;
    • Loss of access to the Services due to external factors (internet connection issues, network failures, etc.).

    13.2 Liability Cap

    In all cases, UnCafé's liability is limited to direct damages and shall not exceed the total amount paid by the User in the 12 months preceding the event giving rise to the liability.

    13.3 User Liability

    The User is solely responsible for their use of the Services and their interactions with other Users. The User undertakes to indemnify and hold UnCafé harmless against any claims, damages, costs or expenses (including reasonable legal fees) arising from their use of the Services in violation of these Terms or applicable law.

    Article 14 – Force Majeure

    In accordance with Article 1218 of the French Civil Code, UnCafé shall not be held liable for failure to perform or delay in performing its obligations in the event of force majeure. In such an event, obligations are suspended and resume within a reasonable period after the event ceases. If the event persists for more than 30 consecutive days, either party may terminate the contract by written notice.

    Article 15 – Protection of Minors

    The Application is exclusively intended for persons aged 18 or over. We do not knowingly collect data relating to minors. If we discover that a minor has created an Account, it will be immediately deleted.

    UnCafé has a zero-tolerance policy towards any content or behaviour involving the sexual exploitation or abuse of minors (CSAE/CSAM). Any content, behaviour or activity involving or encouraging the exploitation of minors is strictly prohibited and will result in the immediate deletion of the Account and reporting to the competent authorities. Users may report any concerning behaviour through the Application's reporting feature or by contacting [email protected].

    Article 16 – Mediation and Dispute Resolution

    In the event of a dispute relating to these Terms, the User is invited to first contact UnCafé at [email protected] in order to seek an amicable solution.

    If no amicable resolution is reached within 30 days, the User may use the following free consumer mediation service:

    Article 17 – Governing Law

    These Terms are governed by French law. In the event of a dispute, and failing an amicable resolution or mediation, the competent French courts may be seized. The mandatory provisions of consumer law of the User's country of residence shall remain applicable.

    Article 18 – Amendments to the Terms

    UnCafé reserves the right to amend these Terms at any time. Amendments will be notified to the User by notification in the Application or by email at least 30 days before they take effect.

    A User who does not accept the amendments must terminate their Account before they take effect. Continued use of the Platform after the amendments take effect constitutes acceptance of the amended Terms.

    Article 19 – General Provisions

    • If any clause of these Terms is declared null or unenforceable, it shall be deemed unwritten without affecting the validity of the remaining clauses.
    • The failure of UnCafé to exercise a right provided for in these Terms shall not constitute a waiver of such right.
    • These Terms constitute the entire agreement between the User and UnCafé regarding the use of the Services and supersede any prior agreements on the same subject matter.
